You are responsible for maintaining the confidentiality of your Account credentials and for all activities that occur under your Account. You agree not to use the Service for any unlawful or prohibited purpose. You are solely responsible for your conduct and any content you submit or transmit through the Service.

YOURSTRULY MAKES NO WARRANTIES OR REPRESENTATIONS REGARDING THE AVAILABILITY, QUALITY, OR SUITABILITY OF ANY PRODUCTS OFFERED BY EXTERNAL RETAILERS. ALL PURCHASES MADE ON EXTERNAL PLATFORMS ARE SUBJECT TO THE TERMS AND CONDITIONS OF THOSE PLATFORMS. YOURSTRULY PROVIDES THE SERVICE ON AN 'AS IS' AND 'AS AVAILABLE' BASIS, WITHOUT ANY WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. YOURSTRULY DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

IN NO EVENT SHALL YOURSTRULY BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING, BUT NOT LIMITED TO, LOSS OF PROFITS, DATA LOSS, OR LOSS OF GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE, EVEN IF YOURSTRULY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. YOURSTRULY'S TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT OF SERVICE FEES PAID BY YOU TO YOURSTRULY IN THE SIX (6) MONTHS PRIOR TO THE DATE THE CLAIM AROSE.

You agree to indemnify and hold harmless YoursTruly and its affiliates, officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, and expenses, including attorneys' fees, arising out of or in any way connected with your use of the Service, your violation of these Terms, or your violation of any rights of another.

YoursTruly may terminate or suspend your access to the Service at any time, with or without cause, and with or without notice.

These Terms shall be governed by and construed in accordance with the laws of the European Union, with particular regard to the General Data Protection Regulation (GDPR).

Any dispute arising out of or relating to these Terms shall be resolved by binding arbitration.

YoursTruly may update these Terms from time to time. We will notify you of any material changes to these Terms by posting the updated Terms on the Service and notifying you within the Service or via email. Your continued use of the Service after the effective date of any such changes constitutes your acceptance of the new Terms.
