Terms of Service

1. Who we are

These Terms of Service (“Terms”) govern your use of the YoursTruly mobile application and the website at yours-truly.io (together, the “Service”). The Service is operated by YoursTruly, based in Rotterdam, the Netherlands (“YoursTruly”, “we”, “us”).

By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

2. The Service

YoursTruly is a gift app and personal AI shopper. You can request gift recommendations, browse products from affiliate retail partners, keep notes on people and groups, and manage related preferences.

We do not sell products ourselves. When you choose to buy, you are redirected to a partner’s website or app to complete checkout. Prices, availability, shipping, returns, and customer support for purchases are determined solely by that partner.

3. Accounts and authentication

You may sign in with a magic link sent to your email address, or with Apple or Google sign-in. We do not offer email and password accounts.

You are responsible for keeping access to your email and linked identity providers secure. You must provide accurate information. You may not impersonate others or create accounts for anyone under the age required by applicable law without appropriate consent.

4. Acceptable use

You agree not to misuse the Service. Prohibited conduct includes, without limitation:

• Violating any law or third-party right
• Scraping, reverse engineering, or overloading our systems
• Uploading harmful, fraudulent, or abusive content
• Attempting to access another user’s account or private data
• Using the Service to distribute spam or unauthorized advertising

5. Affiliate disclosure

YoursTruly may earn a commission when you buy through affiliate links to partner retailers. This does not change the price you pay. Affiliate relationships may affect which products appear or how they are ordered in results. We still aim to show products that match the recipient profile you set.

6. Intellectual property

The YoursTruly name, branding, app design, and original content are owned by us or our licensors. Partner product names, images, and descriptions remain the property of their respective owners.

You may not copy, modify, or redistribute our materials except as allowed by law or with our prior written consent.

7. Disclaimers

The Service is provided “as is” and “as available”. AI recommendations are suggestions only and may be incomplete or inaccurate. We do not guarantee that any product will suit a particular person or occasion.

To the fullest extent permitted by Dutch and EU law, we disclaim warranties of merchantability, fitness for a particular purpose, and non-infringement regarding the Service and partner offerings.

8. Limitation of liability

To the fullest extent permitted by law, YoursTruly is not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill arising from your use of the Service or from purchases on partner sites.

Nothing in these Terms limits liability that cannot be limited under applicable law, including liability for death or personal injury caused by negligence, or for fraud.

9. Termination

You may stop using the Service at any time and may request account deletion through the app or by contacting support. We may suspend or terminate access if you breach these Terms or if we discontinue the Service.

10. Changes

We may update these Terms from time to time. When we do, we update the “Last updated” date on this page. Continued use after changes constitutes acceptance of the updated Terms.

11. Governing law

These Terms are governed by the laws of the Netherlands. Courts in Rotterdam have exclusive jurisdiction, without prejudice to mandatory consumer protections in your country of residence within the EU/EEA.
